Apartment Lease ? (repost from NWR)
Does anyone know where I can pull up renters rights for NYC? We recently moved into a new home, after renting the same apt for 3 years. The landlord owes us the first two months rent that we put down as security. Our apt lease had expired in 2002, and we never signed a new one, so we figured the lease was void and we did not give two months notice prior to moving out. The landlord says that since we did not give notice, he is not giving us back our deposit (over $2000!) According to him, even though the lease was expired, legally we are still bound by it. Anyone know where I can get more info on this? I want to take the b*stard to small claims court, but want to know my rights first. Thanks!!

I was told by a co-worker (law school grad and taught law classes - but did not practice) that when the lease is up you are month to month...so the LL can kick you out...just as easily as you can leave...
I am not 100% about this...but am pretty sure...I asked him...b/c I wanted to move out of an apt where the lease had expired
take them to small claims court...its easy to fill out...my old roommate had to take our LL to court (he threw her clothes out - they were in garbage bags - b/c he was showing the apt)
she had no proof that he did this...and no receipts for the clothes...but she won...

Hi, thanks so much for the info. That is what we thought as well, that after the lease expired (and we have an end date on the lease) that we became month to month. We are going to consult our lawyer, and if that is the case I am hauling his as* to court. This way I can fulfill my long lost career dream of being a lawyer (at least in small claims court)
