Hi Girls-I have some tuesday Controversay regarding 15 yr old girl who was killed in Queens last week. Motorist accidentally killed her. Family wants him punished. What do you think
Young girl and her friends were crossing main street. They were standing on the double yellow lines, when a motorist swerved to avoid a car hit, hit the youung girl and killed her.
Her family wants him punished, she was their only child. But he did nothing wrong. He was not under the influence of anything, it was a freak accident.
Family is outraged and many others want him locked up.
what do you think?

Some lawyer basically said "You lost a loved one and should be compensated" Sad isnt it?
No I don't think he should be punished. It was just that an accident. Bad things happen but Im pretty sure this guy will send the rest of his life suffering anyhow. Why make it worse?
So sad.
Those parents are reacting at a high emotional point and Im sure that someone has been feeding that emotion.

Hope this isn't harsh - but it was an accident. That is what they are called for a reason - they are not meant to happen. As long as the man was found not to be under the influence of any drugs or alcohol, have a personal vendetta against this girl, etc - then it is what it is. It's TERRIBLE don't get me wrong. But may I ask - the person in front of him he was avoiding to hit could be responsible in that case...the street being wet could be the problem...cold hands from the frost. I mean do you sue everybody? Punish everybody?

Yes, I heard about this on the news.
How terribly sad...one family has to deal with the loss of their daughter, another has to deal with the fact that one of them killed a child.
As long as it is certain that the man was not speeding, under the influence, driving recklessly, etc. , I really don't understand what he can be charged with.
Of course, I'm sure I'd feel differently if someone in my family was affected.

This is my moms coworkers daughter that was killed. I say the guy should be punished and sentenced to life in prison

Also the guy that hit the girl swerved around the guy that was driving in front of him because he was going to slow....Supposedly the guy wasnt wearing any pants. He claims that his pants were soaked from the rain, and he took them off.

My cousin was with that girl. It was her best friend. My cousin was hit but only has a brusied leg. It is a terrible tragedy but if it was an accident I don't know what they can do about it legally. Its a very difficult situation. My thoughts and prayers are with my cousin and the girls family. I think we should focus on them.

The going too slow thing is hear-say... just trying to incriminate the driver. (The whole reason behind No Fault insurance... I'm not saying it wasn't true that he did that, just that it may or may not be so). But he wasn't the only party at fault. And I know it sounds crazy, but I've known people who were obsessed with their cars and didnt want to get the seats wet. So yes, as strange as it sounds, I can see how someone would want to do such a thing as taking their pants off (if they were soaked) to avoid damaging their car. It just sounds so bizarre because of the circumstances.
Also - it was POURING rain and there was a street light out where the accident occurred. You know how the lines on the road disappear at night in the rain... due to reflections and whatnot. And as stated previously, the girls weren't necessarily fault-free, they were standing in the middle of a dark, wet road...
I am by no means trying to trivialize the situation, and of course my heart goes out to the child's family. However, this just sounds like a freak accident to me.

yeah - i heard the same thing about the guy not wearing any pants. just in his underware... and used the rain excuse. rain or no rain.. no reason to drive in your underware. but that's not even the issue. it was a terrible accident and if that it was, and no drugs or alcohol involved, then....

Well Jenn I am not as good as you b/c I cant keep my mouth shut on this one. My future 15 yr old cousin knew her and went to teh wake( i put a post up about this ) so maybe i am a little biased b/c i saw the pain of my future cousin but I really think I would feel this way anyway.
From what I heard the girls were not just STANDING in the middle of the street, they were crossing and the guy who killed her was behind a car that was going to SLOW for his taste and sped around him crossing teh yellow line. So yes maybe it was not done intentionally but i see crazy drivers like this all the time and they have no patience and just swerve around soemone who is not going fast enough for them and tehy end up hurting someone.nIn this case KILLING someone!! I think something has to be dne to let it go by is a crime in itself I think. Ia m not saying he should spend teh rest of his lufe in jail but some action needs to be taken.
This is JMO and I hope this doesnt turn in to an LIW war like I have seen happen to other contrioversial topics.

Sept2703, I'm so sorry your cousin has to go through something like this. I also feel terrible for the girls family. It is really a tragedy. I don't know all the details so I can't really make a judgement on whether he should be punished. From what I understand, it was the night it was terrential raining out and the guy was soaked so he removed his clothes to drive home. According to the news he tried to go around a car that was going "too slow" in the rain. The girls were standing on the yellow line in the middle of the street when they got hit. It was a horrible thing to happen and my prayers are with all the families.

This is no doubt a horrible tragedy! If it was a "accident" then that is one thing and the driver should not have the book thrown at him
however, if he swerved and was driving recklessly in the rain no less b/c he felt someone was "too slow" well then he was very negligent and reckless, was he on the wrong side of the road?? pants or no pants, light or no light, slow driver or not, sometimes accidents happen.
If the car in front stops suddenly and he swerves and kills a child, is it his fault if he never saw her? What if he didnt kill a child? What if he just landed on grass, whose fault is it? Usually no one's it was just a close call.
Unfortunately someone died in this 'close call' and it's tragic no doubt but if it was only an accident (mind you Im sure we dont have all the facts) then it's just that.. an accident.
In my point of view, slow drivers are just as hazardous as fast ones. Also I dont care if the man was butt bare naked, it probably wouldnt hinder his driving. Although, oddly enough in Texas it is illegal to drive barefoot. go fig.
My heart does go out to that family, but since I've moved to NY im TERRIFIED to stand out in the middle of those streets.. why do they do that? I drive by those idiots everyday. One even had the nerve to bump up against my car to move past me! I have a tiny car with hardly any back bumper at all, to be close enough as a pedistrian to touch my car means you're within distance for me to kill you.
My god what ARE these people thinking? What in GOD's NAME is so important that you couldnt just WAIT for the next light? Why would you risk your life to get HALFWAY there, when you if you wait a sec you can get all the way there?
I used to live in Kew Gardens Queens, just a block from Queens Blvd (Blvd of Death) and I NEVER understood those wacky people who play with their lives by sitting out there between lanes of rushing traffice and they had MEDIANS for crying out loud! Why, why why why would you EVER stand on double yellow lines on a rainy dark night? I mean I feel for those parents.. but why must any child die when they could just wait for a light?
I really really don't get that at all!
There are a lot of factors in this case. Still, if it were just an accident (again assuming) then she was just in the wrong place at the wrong time.

I agree that *IF* he was just swerving to avoid a car and being a dumbass.. then yah.. he's to blame.. but I still wonder.. in a prudent person mind set would you assuem to find children crossing at that area.
Does anyone know if those kids were crossing in the middle of the street or at a crosswalk?
Curious.
If this man was just being reckless, yah.. he should pay.. but if he was being reckless but if the kids actions put them in the way of danger, then I think some credit is due. Still Im sure this person will live the rest of their lives with this death in their minds.
Still feels like we are missing facts.

I just wonder why NY don't enforce the crossing laws.
When I lived in California, I got a j walking ticket, and then from then on, i crossed at the corners, and while the walk sign said walk.
I understand this may not apply to all areas on NY but still...

I feel TERRIBLE for this girls family.
I must say though, TWICE recently I was driving and got very scared. One time someone was standing in the middle of the road(crossing, it was dark and I didn't see him until I was RIGHT near him. The next time someone was walking on the side of the road (no sidewalk) and again very dark and didn't see him until he was right there. I know first hand if I would have had to swerve out of the way of another car, I could have hit these people. If he purposely swerved b/c the guy was going too slow, that's another story.
Either way, I'm sure this man will live with the guilt everyday for the rest of his life. And her family will live with the pain.

I'm sure the feeling of wanting somebody to be held responsible is normal in this situation but if it is proven to be an accident then thats just what it is. I'm sure unfortunalty lots of ppl die in accidents everyday. Its very sad. Since we are all human and all make mistakes it could of just as easily been anyone else behind the wheel of that car. I do not think he should be punished for what happened. Not that this poor girl deserved this but she should not of been standing in the road. Expecially in such bad weather.

If it were my child, of course I would want to see them punished. However, As a person on the outside looking in, I don't think he should be punished. It was an accident. Unfortunately,the girls should not have been standing in the middle of the road. I think this guy will live the rest of his life with the thought of killing a person. The guilt he will feel for the rest of his life will be punishment enough. Unfortunately, the family is greiving and doesn't see it that way. JMO
